These sale terms and conditions relate to the purchase on the www.adr.it website of airport services managed by Aeroporti di Roma S.p.A.
The sale of such services is made by Aeroporti di Roma S.p.A., with registered office in Via Pier Paolo Racchetti, 1 - 00054 Fiumicino (Rome), Tax code no. and Rome Register of Companies no. 13032990155 - VAT registration no. 06572251004, share capital of 62,224,743.00 Euros, fully paid up  via the website www.adr.it
The Client must carefully read these terms and conditions, regulating the purchase of services made on the www.adr.it website in accordance to what is set out by Legislative Decree dated 6 September 2005, no. 206 ("Consumer Code") and by Legislative Decree dated 9 April 2003, no. 70 (hereafter, "Ecommerce Decree").
Making a purchase according to the established procedures, the Client declares to have read all the instructions given during the purchase procedure and to fully accept these terms and conditions.
ADR, hereafter referred to also as ADR, reserves itself the right to modify such terms and conditions. ADR reserves the right to update the General Terms and Conditions at any time. The updated version of the General Terms and Conditions of Sale is always available at www.adr.it.
Regarding the sale of passenger services, please refer to ADR's ‘romeairports’ site.

Rules for the purchase of Services
The purchase of ADR airport services is complete once a booking number is issued; this will be communicated to the client via an email sent to the email address provided during the booking phase.

The sale will be considered complete when ADR sends the client an e-mail confirming the order relating to the required service, containing:

- name and surname of the client or corporate name of the legal entity
- tax code - VAT registration number (only if legal entity)
- Date of birth (only if physical person)
- Membership number (if required)
- Service(s) required

The email will state the procedure with which to receive the required services and the further information that will need to be provided.

Services offered by ADR:

MEMBERSHIP

  1. Airport permit
    Service for issuing an airport permit with photo ID.
    Duplicate due to theft, loss or damage

  2. Daily airport ID card clone (duplicate)
    Service to request the duplicate of an airport permit.
    The latter will be valid for a day.
  3. Escorted pass for people
    Service required for issuing a visitor day permit. This is not in place for areas open to the public.
  4. Vehicle escorted pass LPM
    Service required for their issue:
    - Permit for vehicle
    - Day Access with escort, also relating to the vehicle/trailer that needs access

To request information and assistance regarding membership registration services it is necessary to email tesseramentofco@adr.it, in case the service is needed at Fiumicino Airport, or tesseramentocia@adr.it, if the service is needed at Ciampino Airport, indicating when possible the booking number, the type of service required, and the contact details of a reference.

OPERATIONAL SECURITY

  1. Escorting vehicles and persons
    Service required for issuing daily permits for escorting vehicles and persons.

TRAINING

  1. End disability
    Basic course for compulsory training pursuant to Circular Enac GEN 02A of 19 December 2014, which contains the rules on assistance that must be offered at airports for Reduced Mobility Passengers. The course, carried out in collaboration with the National Association of Disabled Staff Networks, offers useful suggestions on different abilities and helps to properly manage the relationship - 3 hours.
    At the end of the course you must download and print out your individual certificate of attendance, after passing a final learning test. The course will be considered completed only after passing the test.
    Please note that the training module is delivered in e-learning mode.
  2. Security awareness training course - Cat. A13
    The security awareness training course – Cat. A13 main target is to to provide participants with the basic elements related to airport security, in order to contribute to avoid the acts of unlawful interference against civil aviation, as required by Reg. (EU) 1998/2015, par. 11.2.6. The course is intended for airport operators and staff who need unescorted access to security restricted areas and is preparatory to the issue/renewal of the Fiumicino and Ciampino airport pass. Please note that the training module delivered in e-learning mode is valid for both initial and recurrent training. At the end of the training course, a certificate of attendance valid for a period of five years will be issued upon passing the final assessment test.
  3. Security awareness training course - Cat. A14
    The security awareness training course – Cat. A14 main target is to to provide participants with the basic elements related to airport security, in order to contribute to avoid the acts of unlawful interference against civil aviation, as required by Reg. (EU) 1998/2015, par. 11.2.7.
    The course is intended for airport operators and staff who need unescorted access to security restricted areas and is preparatory to the issue/renewal of the Fiumicino and Ciampino airport pass.
    Please note that the training module delivered in e-learning mode is valid for both initial and recurrent training.
    At the end of the training course, a certificate of attendance valid for a period of five years will be issued upon passing the final assessment test.
  4. ADC - A recurrent training course
    In order to maintain the validity of the airside driving licence, the ADC-A recurrent training course via e-learning is required every 24 months.

General Airport services regulations
Were there a temporary lack of services due to unanticipated reasons, ADR will endeavour to reinstate the regular functioning of services and to minimise any discomfort to clients. In the context of the purchase of the service,
ADR will come into possession of personal data of the client and any other users of the services, which it will process in accordance with the provisions of EU Reg. 679/2016 GDPR and Legislative Decree 196/03 (read information).
For any complaints, suggestions and information requests, please use the email addresses of the specific above-mentioned services, indicating: name of claimant, purchase date for the service and nature of the complaint.

Payment options
Every payment by the client can take place only through American Express, Visa, Mastercard, Diners and Maestro credit cards.
Some data relating to the order number, the amount to be paid and payment completion, which are necessary in order to purchase the required service, will be exchanged between ADR and the Bank on dedicated protected lines and with all the assurance provided by the use of security protocols implemented by payment systems.
ADR does not store personal data and the credit card number used in the purchase, as this information is managed exclusively by the Bank.

Price
The price of services must be considered to include VAT, except for the cases detailed below. In fact, in the case of services rendered in favour of clients who are not residents in Italy (both EU and non-EU subjects), there is no VAT liability due to the absence of the territorial prerequisite (pursuant to Article 7-ter of Presidential Decree No. 633/72): however, the price itself remains unchanged (which will be net of the VAT not due in such cases). The are no further surcharges beyond those highlighted at the moment of purchase, except for any bank or postal commissions.

Invoicing
The sums relating to the services provided will always be invoiced by ADR. To this end, during the on-line purchase, the client will need to complete the sections relating to his personal and tax details.
When the payment transaction is complete, ADR will send the invoice relating to the purchased service via email, to the email account provided. For training services provided by ADR Security S.r.l. the invoice will be issued by the company itself.

Cancellation
Were the service not to be used by the client, it can be reimbursed through a cancellation process. The cancellation must be requested by recorded delivery, addressed to Aeroporti di Roma - via Pier Paolo Racchetti 1, 00054 Rome, to the attention of the service for which the cancellation is requested, starting from 10 working days from the conclusion of the contract (art. 64 and 65 of the consumer code).
The reimbursement of what was paid will be made by ADR within thirty days from the date of reception of the cancellation request. It is not possible to request a cancellation for VIP Lounge services, as in this specific case Aeroporti di Roma commits to provide the service at a specific time (art. 55 paragraph 1 of the consumer code). It is not possible to request the cancellation for membership registration services, airside driving licence, airport supplies and duplicate of the training certificate, as the provision of the service (i.e. of the paperwork) will start once the payment has been made by the client, and anyhow before the 10 working day cut-off date required for exercising the right to cancellation (art 55. paragraph 2 of the consumer code).

Change of name for a person or vehicle
Any name changes for a person or a vehicle indicated as the receiver of the service will be accepted only in certain situations and only after the approval of Aeroporti di Roma. Please contact the individual services, at the emails provided above, in order to request such option.

False statements
By filling the request form for airport services, the purchaser is aware of the penal sanctions in case of false statements, of the creation or use of false documents, referred to in art. 76 of the Presidential Decree 445 dated 28 December 2000.

Privacy policy
The following information is provided in accordance with the current legislation concerning privacy (European Regulation 2016/679 “GDPR” - and Italian Leg. Decree 196/03 and subsequent amendments and additions).

a) Data controller: Aeroporti di Roma S.p.A., with registered office at via Pier Paolo Racchetti, 1 - 00054 Fiumicino (Rome).

b) Types of data processed: The data processed by ADR S.p.A. include personal information such as name, surname, email address and other requests within the individual services chosen

c) Purpose and legal basis of processing: ADR S.p.A. will process your personal data, upon your request, exclusively for the purpose of purchasing e-commerce airport services. The provision of data is necessary for the fulfilment of the above-mentioned purpose; in the event of your refusal to process the data, we will not be able to respond to your online request.

d) The person who enters data on behalf of third persons (family members, friends, colleagues, etc.) declares: (i) to have obtained the data subject's consent to the inclusion of their data and the related service request (ii) informing them of the content of this page

e) In addition, your specific and separate consent may be required for the use of your data for direct marketing purposes, in particular to send you newsletters about airport and air transport services, sales promotions and institutional advertising. The provision of the aforementioned data is optional and, in the event of failure to consent to its processing, the newsletter service will not be provided - although this will not affect the possibility of making use of the other services connected with the e-commerce service

f) Processing methods: The data are processed in compliance with the regulations in force by means of manual, computerised and telematic tools, with logic strictly related to the purposes indicated, so as to guarantee the security and confidentiality of the data.

g) Data retention period Personal Data will only be kept for as long as necessary for the purposes for which they are collected in compliance with the principle of minimisation ex art. 5.1.c) GDPR for a period of 5 years. With reference to promotional and marketing purposes, for a period of 3 years consistent with the purposes and in accordance with the relevant provisions.

h) Data recipients: Only those within ADR S.p.A. who are entrusted with processing by the Data Controller and authorised to carry out processing operations in order to meet the purposes of the aforementioned activities may come into contact with the personal data you have provided. Furthermore, your data can only be processed by the third party companies, which are autonomous data controllers and directly manage and provide the services. The data will also be processed by the company managing and maintaining the platform appointed as Data Processor. The data will also be used by parties handling payment services (bank, post office, etc.). Furthermore, data may also be communicated to the competent public authorities in fulfilment of legal obligations. The aforementioned data will not be disseminated

i) Rights of data subjects: Lastly, please be informed that Articles 15-22 of the GDPR give the data subjects the option to exercise specific rights; data subjects can obtain the following from the ADR Data Controller: access, rectification, deleting, limitation of processing, withdrawal of consent as well as the portability of data concerning them. Data subjects also have the right to object to the processing. In the event that the right to object is exercised, the Data Controller reserves the right not to proceed with the request and, therefore, to continue the processing, in the event that there are compelling legitimate reasons to proceed with the processing that prevail over the interests, rights and freedom of the data subject. The above rights may be exercised either by accessing your booking (email link received at the time of purchase), or by making a request to the Data Protection Officer (DPO) at dpo@adr.it. The contact details of the Data Protection Officer are available at www.adr.it. The rights of the interested party can also be asserted towards the individual service providers, who manage the data as independent data controllers.

General Provisions - Applicable Law – Jurisdiction
a) Should any of the provisions contained in these General Terms and Conditions of Sale be declared invalid or unenforceable, such provision shall be deemed not to have been made and all other provisions shall remain in full force and effect

b) The General Terms and Conditions of Sale together with the Privacy Policy and the documents referred to therein constitute the entire and sole agreement between ADR and the Client regarding the use of the Services

c) Italian law shall govern and give effect to all rights, duties, and obligations arising out of or relating to the subject matter of this Agreement

d) Any dispute arising out of or in connection with the interpretation, application, performance of this Contract shall be deferred to the exclusive jurisdiction of the Consumer Court, pursuant to Legislative Decree No. 206 of 6 September 2005, if such discipline is applicable. Otherwise, the Court of Rome shall have exclusive jurisdiction.
